These Terms of Service ("Terms") govern your use of the Headstash brand platform, operated by Tuff Ghost Media LLC ("we," "us," or "our"). By accessing or using Headstash as a brand partner you agree to these Terms. If you do not agree, do not use the platform.
Headstash provides cannabis brands with infrastructure to run receipt-based loyalty campaigns. The platform enables consumers to photograph dispensary receipts, earn rewards tied to qualifying purchases of your products, and redeem those rewards directly through your brand.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate business information and to keep it current. Notify us immediately if you suspect unauthorized access.
As a brand partner you agree to:
Consumer data collected under your campaigns belongs to you. You are the data controller; we act as your data processor. You are responsible for ensuring your use of consumer data complies with applicable privacy laws. Upon cancellation, your data remains available for export for 90 days, after which it may be deleted.
Fees are as specified in your brand agreement. Founding-rate pricing is locked for the duration stated in your agreement and does not increase during that term. After the founding-rate period, standard pricing applies with 30 days written notice before any rate change.
You retain all rights to your brand assets, campaign creative, and customer data. We retain all rights to the Headstash platform, codebase, and infrastructure. You grant us a limited license to use your brand name and assets solely to operate your campaigns on the platform.
Headstash operates as a marketing technology layer and does not facilitate the sale or distribution of cannabis products. You are solely responsible for ensuring your use of the platform complies with all applicable state cannabis laws, advertising regulations, and data privacy requirements in each market where you operate.
Either party may terminate the brand agreement with 30 days written notice. We reserve the right to suspend or terminate accounts that violate these Terms immediately and without notice. Upon termination, your access to the platform ceases and your consumer data becomes available for export.
The platform is provided "as is" without warranties of any kind. We do not warrant uninterrupted availability, specific campaign performance outcomes, or that the platform will meet all of your requirements.
To the fullest extent permitted by law, Tuff Ghost Media LLC's total liability to you for any claim arising from your use of the platform is limited to the fees paid by you in the three months preceding the claim. We are not liable for indirect, consequential, or punitive damages of any kind.
These Terms are governed by the laws of the State of California without regard to its conflict of law provisions. Disputes will be resolved in the courts of Los Angeles County, California.
We may update these Terms with 30 days notice via email to your account address. Continued use of the platform after that period constitutes acceptance of the updated Terms.
